Who is Exempted from EPF Contributions?

Under the EPF Act 1991, the following individuals are NOT required to contribute to EPF:

❌ Exempted Individuals：

1️ Indigenous Nomads (Orang Asli) unless recommended by the Minister of Indigenous Affairs.

2️ Domestic workers defined under the Workmen’s Compensation Act 1952, including:

• Maids
• Cooks
• Security guards
• Gardeners
• Private drivers

Exceptions: They must contribute if employed by:

• Employers listed in the Second Schedule of the Act
• Registered associations or cooperatives
• Businesses registered under the Business Registration Act 1956, Sabah Trade Licensing Ordinance, Sarawak Business, Professions, and Trade Licensing Ordinance, or Sarawak Business Ordinance
• Statutory corporations established under any written law

3️ External employees as defined by the Workmen’s Compensation Act 1952.

4️ Detainees in prisons, Henry Gurney schools, detention centers, psychiatric hospitals, drug rehabilitation centers, or leprosy hospitals under the Drug Dependants (Treatment and Rehabilitation) Act 1983.

5️ Members of the Administrative Authority as defined in Article 160 of the Federal Constitution.

6️ Foreigners who opt out of EPF contributions.

7️ Employees aged 75 years and above.

1991年公积金（EPF）法案列明以下的人士无需缴付公积金(EPF):

1. 游牧土著居民，除非在某些情况下由原住民部长推荐
2. 1952年工人赔偿法案 第3条界定的家佣，如佣人，厨师，保安，园丁和私人司机，除非是在以下情况被雇用的

a 该法案第2列表列明的任何雇主
b 已经或是需要注册在任何法律下的社团或是合作社
c 1956年生意注册法案 ，沙巴州交易许可条例 ，沙捞越州商业，职业和贸易许可条例或沙捞越州商业条例下注册的任何生意; 或是
d 根据任何成文法成立的企业

3. 1952年工人赔偿法案定义的外部员工；
4. 1983年药物依赖者法案或麻风病院定义的的任何监狱，亨利·格尼学校，看守所，精神病院或康复中心的拘留人员
5. 联邦宪法第160条定义的行政部门成员.
6. 选择不缴付的外国人;
7. 已达75岁的员工。
